1. General information, the conclusion of a contract between the Parties

The terms and conditions of the contract describe the relationship between the webshop and you dear Buyer. For easy understanding the essence is highlighted on a yellow background.

These General Terms and Conditions (hereinafter: the General Terms and Conditions) are governed by Icotrade Online Kft. (Registered office: 1023 Budapest, Árpád fejedelem útja 44., registration number: 01-09-978086, registered by the Municipal Court of Budapest, VAT number: 23791239-2-41; (hereinafter referred to as "the Service Provider") and the Customer using the electronic commerce services (hereinafter referred to as "Customer") provided by (Service Provider and Customer hereinafter jointly referred to as "Parties").

1.1. This General Terms and Conditions apply to all electronic commerce services provided by the electronic store of (hereinafter referred to as "the Webshop") (hereinafter: in the territory of Hungary. In addition, the present GTC covers all commercial transactions in the territory of Hungary, which is established between the Parties specified in this Agreement. Purchasing at store is governed by the CVIII 2001 Law on electronic commerce services, certain aspects of information society services. The information provided in Section 5 (2) and Section 6 (1) - (2) of this Act is contained in the "Order" section of this GTC.

1.2. Purchase in the store is possible by an electronical order, as specified in this GTC.

1.3. The services of the store can be used by any natural or legal person, if validly and successfully registered on the Webshop and agree to be bound by this GTC.

1.4. The contract between the parties will be completed by filling all mandatory fields of the order form and checking the entered data, accepting the present GTC, selecting the delivery and payment method and clicking on the "Confirm Order" icon. The contract concluded between the Parties in this manner, in Hungarian, is a written contract, the Service Provider records it and keeps it for the period prescribed by the legal regulations in force. The parties also clarify as contract those commercial transactions made through Provider's customer service (in writing, personally or by phone). The Service Provider provides information on the content of the contracts at the Client's written request.

2. Customer information

2.1. The essential features of the goods purchased, their characteristics, instructions on how to use the goods can be found in the information page of the goods or in user's guide supplied with the product. If you have a question about the goods before buying, our customer service is at your disposal. The user’s guide is always attached to the product, where this is required by law . If you do not receive this guide, immediately contact our customer service. If you need more information about the quality, the essential property, the use, the usability of any product on the Webshop, please contact our customer service.

Of course, we can help you with anything, and even if you come to our showroom, you can try most of the chairs - we are happy to see you!

2.2. The purchasing price is always the net price indicated next to the selected product, which does not include the VAT. The purchasing price of the products does not include the cost of delivery, but after the selection of the delivery mode, the basket shows it. Many products in the webshop can be ordered in a variety of configurations. As the final price of the products varies depending on the specific composition chosen by the Customer, therefore the price listed for each product in the list of products (category list) shows the price of the basic product configuration. Nevertheless, the price indicated on the product page detailing the characteristics of each product will in all cases indicate the final price of the actual assembly selected by the Customer. Similarly to the products placed in the basket, the price displayed next to the product reflects the price of the selected assembly. Before the order is closed, when the payment method is selected, the gross amount of the order plus the VAT will be displayed, which will be accepted by the Customer by clicking on the "Confirm Order" button.

Most of our chairs are available in several designs. Of these, there are models with premium features (eg chrome frame or overlay fabric), so you can assemble combinations that are different from the originally displayed price. The final price is only visible after you select them. Options available for chairs (eg armrests, special rollers, etc.) are stand-alone products, which should be placed in the basket in the desired quantity.

2.3. The Service Provider reserves the right to change the prices of products ordered from the Webshop by the effect that the amendment will come into effect simultaneously with the appearance of the Webshop. The change does not affect the purchase price of the products already ordered. If, despite the care of the Service Provider, a defective price is placed on the Webshop the Service Provider is not obligated to deliver the product at a defective price, but may offer a delivery at a fair price, in the knowledge of which Customer may withdraw from his intention to purchase.

2.4. When choosing a delivery by home, the Service Provider will deliver the ordered goods to the house by the delivery deadline, using their own means of transport or using a forwarding agent. In the case of an order the delivery fee shall be borne by the Customer in such a way that its exact amount is indicated on the order. The Service Provider reserves the right to change the shipping fee by the effect that the amendment will enter into force simultaneously with the appearance of the Website. The change does not affect the purchase price of the products already ordered. Upon completion of the order, the Service Provider may contact the Customer in order to reconcile the details of the order in which the exact charge of the delivery may vary according to the Client's agreement.

3. Ordering

3.1. By clicking on the "Login" link on the Home page, you can sign up for a valid email address in the "Register New User" box by filling in personal and address information. Registration is optional. The Service Provider shall not be liable for any damages arising therefrom if the Customer forgets his or her password or becomes unavailable for any unauthorized person for any reason not attributable to the Service Provider. The customer's password is stored by the Service Provider in encrypted form so that a forgot password can only be requested for a new password by clicking on the "Forgotten Password" link by entering the registration email address. You can change the incorrectly entered data after logging into the "Accounts and delivery addresses" or "Personal data" items in the "User Account" window.

You can also register at our webshop, so you do not have to re-enter your data.

3.2. The data network operator interface maintained by the Service Provider is accessible both domestically and abroad from the Internet. Icotrade Online Ltd. is currently accepting orders directed exclusively to Hungary.

You can still order our Webshop only to Hungarian address, but if you contact us, we'll find out a solution for foreign shipment.

3.3. By posting a Customer Order, you declare that you agree to these GTC and be bound by it.

3.4. After receiving the Customer's purchase order, the Service Provider confirms the purchase by electronic means (by e-mail). If this confirmation does not arrive to Customer within 48 hours after sending the order, the Service Provider's bid or Customer's obligation to purchase will be terminated automatically without any additional conditions.

3.5. The Service Provider reserves the right to delete the data and the order if it is placed with invalid data or if the authenticity of the customer's information is questionable or imprecise. The Service Provider reserves the right to request, by telephone or email, confirmation of the electronically placed order, and to declare the order invalid if this request failed.

It is possible that we will contact you by phone for negotiation within 1-2 days, so we ask you to enter your phone number (this is also important for shipping). In all cases, we call with the number display.

3.6. After the order has been approved, the order can not be canceled electronically. Cancellation of the order can be made by the Customer via the Customer Service e-mail address or by telephone. Cancellation of the order is possible only before handing over to the courier service.

If you have changed your mind, please let us know as soon as possible to change your order.

4. Payment Terms

You can pay us at:
- bankcard (currently only for personal receipt)
- up to 100,000 HUF in cash on delivery
- up to 100,000 HUF in cash or by bank card on personal receipt
- with advanced payment by bank transfer (in case we can send a Proforma)
- over HUF 100,000 with a 50% advanced payment, the remaining 50% payable on arrival of the goods

5. Delivery terms

5.1 Delivery time

Part of the products are in stock, other products are shipped from our central warehouse approx. within 7 to 10 days, delivery time for other products is 30 days. If you would like to get the selected chair faster, choose from the products in stock or contact us to find a solution.

The Service Provider supplies the ordered goods from a local warehouse, a central warehouse, or order them at the producer- depending on the stock. In first case the delivery is expected within two working days, in the second case within 7-10 days, in the third case within 30 days. If the expected delivery time exceeds the estimated delivery time more than 50%, the Service Provider will notify the customer electronically.

5.2 Delivery

We can deliver to you:
- you come into the shop and take it personally
- we send out by courier service
- larger orders are taken by our colleagues

The chairs are supplied in an original cartoon box, generaly without assembling. If you would like to ask for assembling of chairs, please inform us at the time of ordering or afterwards by phone and we will give you an offer. With courier service we can only deliver the chairs in an original box, disassembled.

The Service Provider provides a delivery service by personal receipt, courier service or agent. Personal receipt may be made during opening hours, in case of shipment by authorized means, the Service Provider shall agree the time with you in advance. In case of courier service, the terms of the courier service contract are governed.

Customer's misrepresentation and / or inaccurate ordering data may cause delayed delivery or other problems. In this case the Service Provider shall not be liable for any errors.

6. Right, way and consequences of withdrawal

If you think about it or you are not satisfied with the chair, you can return it back within 14 days of receiving it and return the seat price. You can try chairs in our shop beforehand, or even get personal advice so you can be assured of choosing the best possible chair. And, of course, if you have any problems - please feel free to contact us. As a business client, the right of withdrawal does not apply to you, but we ask you to contact us in this case as well.

6.1. Customer is entitled to withdraw from the contract within 14 calendar days of receipt of the ordered product. The exercise of the right of withdrawal is possible from the date of acceptance of the goods (personal or dispatch). The procedure for withdrawal from the distance contracts, 45/2014. (II.5.) Government Decree. The withdrawal statement may be communicated by the Customer to the Declaration of Annex 2 to the Government Decree or to the Service Provider in the given telephone number, postal or e-mail address.

When exercising the right of withdrawal, the Customer shall return the Product to the Service Provider at his / her own expense, without undue delay, within 14 days of posting it. To exercise the right of withdrawal, please return the goods to the specified customer service address in complete package. The product can not be returned to the Service Provider by payment on delivery.

6.2. In the event of a withdrawal, the Service Provider may require the consumer to reimburse the damages resulting from the misuse of the goods. In addition to the above, the Customer will not be charged any other costs with respect to the cancellation.

6.3. The provisions of this clause apply solely to our Clients (Customers) who are contracted for purposes other than economic or professional activity.

7. Warranty

We have a warranty for the chair, in each case at least 3 years and 5 years warranty on some brands. During this time, we will repair all defects of your chair in case of proper use. Really. You bring it back and we repair or replace the defected part.

7.1. Mandatory warranty

For the products of the Service Provider, the Civil Code and the Decree 151/2003. Korm., Which guarantees that during the warranty period only the liability is exempted if it proves that the defect is due to improper use of the product. Continuous use of products in multiple shifts is not considered as intended use.

The warranty period (warranty period) begins with the actual delivery, ie the delivery of the product to the Customer or the commissioning of the product. Consistent consumer goods are defined in the Government Decree 151/2003 on the compulsory guarantee for certain durable consumer goods. (IX.22.), For which the statutory obligation is mandatory for one year.

7.2. Voluntary warranty

For its products, the Service Provider undertakes a Warranty (Warranty) indicated on the Website Prospectus, (IX.22.) Government Decree may be longer. The Service Provider indicates the duration of the warranty for each product at the latest by the data provided on the guarantee certificate (warrant) issued by the Customer upon receiving the product.

7.3. Warranty

In the case of a consumer contract, the Customer is entitled under the provisions of the Civil Code to enforce his rights of custody within a two-year limitation period from the date of performance. After discovery of the fault, the Customer shall immediately inform the Service Provider of the error. Towards the Service Provider. If failure to notify within two months of its discovery, the Service Provider may, under the provisions of the Civil Code, require the Customer to reimburse the additional damage caused by further use.

7.4. The Customer may enforce his / her warranty rights by the Service Provider's performance, ie the date of receipt of the goods, during the warranty period.

7.5. Customer is only entitled to claim the warranties of the warranties of the Service Provider delivered at the time of receipt of the product or the invoice issued for the payment of the payment. The customer must prove the fact of the purchase without any doubt. In all cases, the warranty terms for each product are governed by the warranty card.

7.6. During the warranty period, the Service Provider undertakes to replace or rectify the defective product at the Customer's option, unless the repair or replacement is possible or a Service Provider would be in a disproportionate additional cost compared to the fulfillment of the other warranty claim. If repair or replacement is not possible, or if the Service Provider has not undertaken to do so, Customer may choose to charge a suitable price or cancel the contract if all of these are allowed by the Warranty Card. There is no place for a withdrawal due to an insignificant error.

7.7. If the Client validates replacement requests within three working days of the delivery of the product due to the defect of the product, the Service Provider shall provide replacement of the product, provided that the defect prevents its intended use.

8. Data Management

8.1. In any case, the purpose and legal basis of data management is the establishment or intent of a business relationship. The Service Provider shall store the data provided by the Customer exclusively for the purpose of completing the order, later proving the order conditions and for subsequent commercialization. The data will not be disclosed to third parties unless it is subcontracted to perform the contract. The Client may at any time request information on stored personal data, correction or modification of the data.

We take care of your data as we want you to take care of our data. We do not use anything you do not want and of course you can ask them to delete them at any time.

8.2. While browsing the webshop, technical information is recorded for statistical purposes. (IP address, visit duration, browser type, screen size, etc.). The Service Provider submits these data to the authorities only in a legally binding manner. You must enable cookies to access the service. If you do not want to enable cookies, you can disable it in your browser settings. When blocking cookies, some features of the service are only partially or totally unavailable.
